鋸斷蔣介石銅像占為己有 男子判刑6月
郭姓男子因不滿威權象徵，涉嫌鋸斷台北市陽明公園內的故總統蔣介石銅像頭部，並占為己有。高院今天依攜帶凶器竊盜罪判刑6月，可上訴。
台灣高等法院新聞資料指出，郭姓男子於民國106年4月間，攜帶菜刀、鋸條、榔頭等工具，前往北市北投區陽明公園辛亥光復樓前，先持綁有菜刀的竹竿作勢揮砍蔣介石銅像並拍照，再鋸下銅像頭部並帶走。
郭姓男子供稱，要把銅像頭部帶回去當尿壺，未來台灣獨立建國並建立二二八事件紀念館後，再捐出銅像頭部。
高院認為，郭姓男子有竊盜犯意，且促進轉型正義條例規定，威權統治者象徵物如何處置由促轉會決定，且並非僅有移除一途，郭男恣意鋸除銅像頭部，與立法者透過促進轉型正義條例所欲彰顯的法秩序價值相違背，不能免責。
高院審酌，郭姓男子主張早必買清單2018流行產品日實現轉型正義，卻逾越言論自由所必要、適當的範圍而犯案，考量他有意與台北市政府公園路燈管理處和解，及公燈處已領回銅像頭部等因素，撤銷一審的8月徒刑判決，改判6月徒刑，得易科罰金，仍可上訴。（中央社）
